Match House Platform License Agreement Adherence Terms
Welcome to Match House!
Match House ("Platform") connects Clients and Real Estate Agents ("you/users") uniquely when it comes to buying and selling properties. With Match House, the Client has a personalized experience to find their dream property through automated searches and geolocation.
In addition to finding the ideal property, it's possible to connect with specialized Real Estate Agents, enabling the perfect match between Clients and properties registered on the Platform.
By registering on our Platform, you agree to the general terms and conditions of use ("Terms of Use"). If you do not agree to these Terms of Use, you may not access or use Match House services.
The Privacy Policy is also part of the rules and conditions of use and can be consulted on the Match House Platform and/or website. Continued use of the Platform implies acceptance of any changes or modifications made to the Terms of Use and Privacy Policy.
To understand how everything works, we present the Platform's Terms of Use, regulating the relationship between you ("User") and Match House.
General Terms and Conditions:
1. Object
1.1 This Terms of Use aims to regulate the rules and general conditions of use of the Match House platform, an application ("Platform") offered by Match House to facilitate the purchase, sale, and rental of properties of any nature, connecting the Client to Real Estate Agents on the Platform.
1.2 License of Use. Match House grants Users a license to use the Platform, for an indefinite period, on a non-exclusive, limited, and non-transferable basis, subject to the conditions of these Terms of Use and others provided on the Match House Platform and website.
2. Platform Plans:
2.1 Match House offers:
a) Free Platform for the Client seeking their dream property;
b) Paid plans for the Real Estate Agent to offer the best experience and exclusivity to Clients matched on the Platform.
2.2 Contracted Plan. To access all functions of Match House, the Real Estate Agent must choose one of the available plans ("Plan") and make the payment ("Contracted Plan").
2.3 Exclusivity. After registering a property on Match House, the same property cannot be registered by another Real Estate Agent. This measure aims to guarantee the security and accuracy of the ads, avoiding the dissemination of incorrect information and values ​​regarding the property.
2.4 The Real Estate Agent is solely responsible for the advertisement, negotiations, accuracy, updates, and deletion of information related to the property. To be entitled to exclusivity, the Real Estate Agent must choose the respective Plan, which will last as long as they are up to date with the payments of the Contracted Plan.
2.5. In case of payment delay, the Plan is automatically disabled for all functions, and the property loses exclusivity, being able to be registered by another Real Estate Agent
2.6. Payment Methods. The Real Estate Agent must choose a payment method between credit card, PIX, or bank slip for the charging of the amounts related to the chosen plan, as well as any fees and taxes on sales and other expenses applicable to the use of the Platform.
2.7. Fees. It is important to note that some payment methods may be subject to bank fees. It is advisable to consult the financial institution responsible for the chosen payment method for detailed information.
2.8. Payment and price changes. Match House reserves the right to change the available payment methods and the prices published on the Platform or website at any time without prior notice. The changes will be applied upon renewal of the Contracted Plan.
2.9. Recurring payments. If the Real Estate Agent chooses a recurring payment method, they authorize Match House to automatically charge the amounts due according to the conditions established in the Contracted Plan.
3. Registration, Access Information, and Evaluation:
3.1. Updated Registration. When registering, you must fill in the requested information correctly on the Platform. In case of any changes, it is your responsibility to update the registration information on your profile under penalty of accountability for incorrect information.
3.2. Platform Access. You must choose a password and verify the registration through validation done by the Platform. Access data to the Platform are for exclusive and non-transferable use.
3.3. Trial Period. Upon registration, the Real Estate Agent may receive a free trial period, at the sole and exclusive discretion of Match House. The trial has limited functions that will only be unlocked with the subscription to the offered plans.
3.4. Access to the Contracted Plan. The release of the Contracted Plan will be effective after the payment is cleared, within a period of up to 5 (five) business days.
3.5. Evaluations. The Platform allows for the evaluation of Clients and Real Estate Agents. The evaluations are public to all users. A low rating may indicate that you are not complying with obligations provided in these Terms of Use. At the discretion of Match House, the recurrence of low ratings and negative comments will result in the banning of platform use for an indefinite period.
4. Obligations:
4.1. Users undertake to:
a) Information Registration. Input all necessary information for the use of the Platform, declaring that it is true, complete, and up-to-date;
b) Information Update. Keep all information updated on the Platform;
c) Information Provision. Provide all necessary information for the disclosure of properties registered on the Platform, such as photos, their characteristics, location, available visitation times, among others;
d) Relationship. Maintain civility and respect with other Users and third parties related to the execution of these Terms of Use. Match House does not permit any discriminatory and/or morally reprehensible conduct;
e) Platform Password. Maintain the confidentiality of the password, being entirely responsible for any damage resulting from the misuse of access and all activities that occur after sharing the Platform password with third parties;
f) Internet Connection. Have a good internet connection for access to the Platform; and
g) Related Regulations. Observe all conditions provided in these Terms of Use, including, but not limited to, the Privacy Policy and other regulations relevant to the execution of Match House activities.
4.2. The Real Estate Agent undertakes to:
a) Formal Regularity. Maintain fiscal and formal regularity for the provision of their services, such as regular registration with the CRECI, and shall not perform any service in case of non-compliance;
b) Methodology. Perform their activities diligently, observing market technical standards and those recommended by official institutions;
c) Customer Service. Serve the Client according to the contracted service, in their time and manner, observing their technical qualifications and legally permitted abilities, relating to the Client in a respectful, dedicated, and empathetic manner, without any intervention in their private life, maintaining the confidentiality of all information accessed through the relationship with the Client, providing the Client with the best experience in choosing the property
d) Payment Data. Ensure that the provided payment data is correct and up-to-date, as well as notify Match House immediately in case of any problem or error related to payments;
e) Damage Repair. Repair any damages caused to Clients, employees, and/or third parties arising from their services and from the misuse of the Platform. Indemnify Match House for all losses, convictions, contingencies, expenses, fines, and penalties of any kind that may be incurred as a result of the improper use of the Platform and that may affect Match House;
f) Protection of Commercial Image. Not perform any act that may compromise or violate Match House's commercial image before third parties, including but not limited to: disclosure, use, or commercial exploitation of any confidential information, violation of copyrights, misuse of trademarks, disclosure of defamatory information, involvement in ethically and morally reprehensible practices, or any other practice that may harm Match House's commercial image before third parties; and
g) Lawful Activities. Use the Platform only for lawful purposes, as the use for unlawful purposes constitutes grounds for immediate termination.
5. Campaigns:
5.1. Campaigns. Match House may, at its discretion, carry out campaigns, facilities, discounts, prizes, and/or agreements for Real Estate Agents. Participation involves compliance with their own terms and conditions, with rules and requirements for adherence.
5.2. Termination of Campaigns. Match House may alter and/or terminate any campaign without prior notice.
6. Limitation of Liability:
6.1. Match House does not sell properties! Our role is to provide technology to facilitate the connection between Clients and Real Estate Agents, not being responsible for any conduct of Users and third parties, and not liable for any damages caused, including but not limited to:
a) Bank transactions, credit, and information sharing carried out directly between Users, even if the contact originated from the Platform;
b) Tax, administrative, and other obligations arising from the purchase, sale, and/or rental of properties;
c) Information that is disseminated through upload, distribution, messaging, email, or any other means made available outside the Platform, not being liable for any damages caused of a civil, criminal, or any other nature.
d) For the activity and/or conduct of Users; and
e) For information that is disseminated through upload, distribution, messaging, email, or any other means made available outside the Platform, not being liable for any damages caused of a civil, criminal, or any other nature.
7. Technical Support:
7.1. Maintenance. Match House may perform maintenance, updates, and improvements, which may result in the interruption or temporary suspension of the Platform. Any inquiries regarding technical support should be sent to the official support channel.
8. Intellectual Property:
8.1. Copyright Violation. The use of intellectual property rights associated with Match House should be restricted to the execution of these Terms of Use. Match House does not assign any intellectual property rights.
8.2. Reproduction, copying, adaptation, modification, alienation, rental, assignment, reverse engineering, or decompilation of the Platform, in whole or in part, or using it for any purpose other than what is specifically authorized is expressly prohibited, as well as using the brand without prior authorization.
9. Privacy and Data Protection:
9.1. The Privacy Policy is available on the Match House Platform and/or website, and Users declare their awareness and agreement.
10. Account Cancellation:
10.1. Client Account. If you have already found the perfect property and wish to end your relationship with Match House, simply deactivate your account directly on the Platform. Remember, you are always welcome back to the Platform.
10.2. Real Estate Agent Account. Canceling a Plan does not delete your account! Nevertheless, if you ever wish to end our relationship, you can do so by deleting your account. You can return to the Platform whenever you want!
11. Suspension and Unilateral Cancellation:
11.1. Match House reserves the right to unilaterally cancel, suspend, deactivate, block, or terminate these Terms of Use with Users in the following situations:
a) If any violation of legal norms and conduct rules provided in these Terms of Use or other Match House policies is identified;
b) If the registered information is not true;
c) Delay in payment of the Contracted Plan;
d) If any direct or indirect damage is caused to Match House or third parties in the execution of these Terms of Use;
e) Discontinuation of the company or lack of commercial interest; and
f) In other cases when Match House, at its sole discretion, deems it necessary.
11.2. Match House may refuse to provide any of its services to Users who have not observed these Terms of Use or any of its policies.
12. Final Provisions:
12.1. Contractual Changes. These Terms of Use may be amended at any time to meet new needs and will be published on the App and/or Match House website, without affecting ongoing operations. If you do not agree with the changes to the Terms of Use, you may terminate your relationship with Match House.
12.2. Legislation. These Terms of Use are subject to Brazilian laws.
12.3. Jurisdiction. To settle any disputes arising from these Terms of Use, the Parties elect the jurisdiction of Vitória, ES.
13. Questions:
13.1. If you have any questions about functionalities, plans, and other matters, you should seek Match House's customer service channels for assistance.
14. Users' Declaration:
14.1. Users declare the following:
a) They have full knowledge of the conditions of use of the Platform;
b) Match House bears no responsibility for the conduct of Clients, Real Estate Agents, and third parties, nor does it bear responsibility for any legal transactions entered into between Users, including real estate transactions such as buying, selling, swapping, or renting properties; and
c) By registering on the Platform, Users agree to all conditions and formally engage the services of Match House described in these Terms of Use.
